These Terms of Use (“Terms”) constitute a legal agreement between you (“User”) and Sixtwentyeight LLC (“Company,” “we,” or “us”) governing access to and use of the NXTFieldApp (“App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, you must not use the App.
1. License Grant
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use NXTFieldApp solely for lawful operational purposes in connection with your employment or contractual engagement.
2. User Accounts and Authentication
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must promptly notify us of any unauthorized access or suspected security breach. We reserve the right to disable accounts associated with suspicious or fraudulent activity.
3. Acceptable Use and User Conduct
You agree not to use the App to:

Upload, share, or transmit any material that is obscene, pornographic, violent, hateful, racist, or discriminatory.

Disseminate malware, spam, or unauthorized data collection scripts.

Violate any applicable law, regulation, or third-party right.

Attempt to interfere with the security, integrity, or availability of the App or related systems.
Violation of this policy may result in immediate suspension or termination of access at our sole discretion.
4. Data Collection and Consent
By using NXTFieldApp, you consent to the collection and use of information as described in the accompanying POLITICA DE CONFIDENȚIALITATE, including the use of camera, microphone, and GPS data while the App is in operation.
5. Intellectual Property
All content, trademarks, software, and technology used in or associated with NXTFieldApp are owned or licensed by Sixtwentyeight LLC. You are granted no rights other than those expressly provided under these Terms. You may not copy, decompile, or distribute any part of the App without prior written permission.
6. Suspension and Termination
We reserve the right to suspend or terminate your access to NXTFieldApp at any time, without notice, for conduct that we determine in our discretion violates these Terms, our policies, or applicable law. Upon termination, all rights granted to you shall cease immediately.
7. Disclaimer of Warranties
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
SIXTWENTYEIGHT LLC DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIXTWENTYEIGHT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE APP.
9. Indemnification
You agree to defend, indemnify, and hold harmless Sixtwentyeight LLC, its affiliates, officers, and employees from any claims, liabilities, damages, or expenses (including reasonable attorney’s fees) arising from your violation of these Terms or misuse of the App.
10. Governing Law
These Terms and any dispute arising under them shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict-of-law provisions.
11. Dispute Resolution
Any claim or dispute arising out of these Terms shall be resolved through binding arbitration or small-claims proceedings, unless prohibited by law. Users agree to waive the right to a jury trial.
12. Modifications
We may revise these Terms at any time by updating the version available in the App or on our website. Continued use after such updates constitutes acceptance of the revised Terms.
